To the fullest extent permitted by law, the Guests hereby (i) agree that Owners shall not be liable to any Guests or any other person for any property damage, personal injuries or illness that have, or may have, occurred in or about the Property, for any reason, whether the result of proper use or misuse of the Property, natural events or disasters, negligence, intentional misconduct or general accident (collectively, “Damages”), (ii) waive any right to bring any claim or action against any of the Owners for Damages, (iii) agree to indemnify and hold harmless each of the Owners against any and all claims, liabilities or costs (including court costs and reasonable attorneys’ fees) incurred by the Owners as a result of any claim or action brought by any Guests or any other person for Damages, and (iv) agree to reimburse each of the Owners for all expenses and damages, including reasonable attorneys’ fees, suffered by the Owners by reason of a breach, violation or non-performance by any Guest of any law, rules of the Mountaineer property, or the terms and conditions set out in the Property listing, including this Waiver and Release of Liability (this "Waiver"). Guests acknowledge and agree that by booking a reservation for the Property, they are deemed to have agreed to all terms and conditions set out in the Property listing, including this Waiver, and that this Waiver shall survive Guests’ booking and stay at the Property and shall be governed by the internal laws of the State of Vermont, without regard to principles of conflicts of interest.
